U.S. Supreme Court, 1948 · the racially restrictive covenant case
Holding. Although private parties may agree among themselves to discriminate, judicial enforcement of a racially restrictive covenant constitutes state action subject to the Equal Protection Clause. Courts cannot lend their power to enforce private discrimination.
Why it matters. Even where the underlying agreement is private, courts cannot enforce it — that enforcement is itself state action.

Mini IRAC · build the Application

Issue. Does a privately owned hospital's discharge of an indigent patient constitute state action where the hospital is heavily regulated and partly funded by the state?
Rule. Private conduct constitutes state action only where the private actor performs a traditional exclusive government function or is sufficiently entangled with government to be fairly attributable.
Application (model). The hospital is private, though regulated and partly funded by the state. Because regulation and funding alone are insufficient to render private conduct state action — and operating a hospital is not a traditionally exclusive government function — the fact that the hospital's regulation and funding do not rise to the level of entanglement required by Burton/Brentwood means there is no state action.
