Issue. Should the federal court grant declaratory judgment determining whether an insurance policy covers a specific liability before the insured is sued?
Rule. A federal court has discretion to grant declaratory judgment in cases of actual controversy, allowing parties to clarify legal rights before damage occurs.
Application (model). The insured faces an ongoing dispute over coverage; the insurer denies coverage and the insured needs to know whether to defend at its own expense. Because the Declaratory Judgment Act permits declaration in cases of actual controversy, the fact that the coverage dispute is concrete and ripe — though not yet resulting in a final liability — means the court has discretion to declare.
