Van Valkenburgh v. Lutz
Holding. Adverse possession requires actual use of the land as an ordinary owner would use it. Building a small shed and cultivating a portion of a contested lot is insufficient where the possessor did not substantially improve or enclose the entire claimed area for the statutory period; the burden of proof is on the claimant.
Why it matters. Possession must look like ownership — substantial, visible, and over the entire area claimed.
占有須像所有人之使用 — 實質、可見、覆蓋整個主張之區域。

✗ 間斷使用也算 continuous。
✓ Continuity is judged by ordinary use of similar land.
以同類土地之尋常使用判定。
✗ 經所有人「默許」可進行 AP。
✓ Permission destroys hostility.
許可消滅敵意。
Mini IRAC · build the Application
Issue. Did P acquire title to the disputed strip of land by adverse possession after 22 years of fenced, continuous use, where the statutory period is 20 years?
Rule. Adverse possession vests title in the possessor whose possession is open and notorious, continuous, exclusive, and hostile for the statutory period.
Application (model). P fenced the strip, mowed it weekly, and parked vehicles on it for 22 years without the record owner's permission. Because adverse possession requires possession that is open and notorious, continuous, exclusive, and hostile for the statutory period, the fact that P's fence and weekly use were highly visible — and continued without permission for over 20 years — means each element is satisfied.
