Asylum requires the applicant to demonstrate past persecution or a well-founded fear of future persecution on account of race, religion, nationality, political opinion, or membership in a particular social group; the application must generally be filed within one year of arrival; even if eligible, asylum is discretionary.

INS v. Cardoza-Fonseca
Holding. "Well-founded fear of persecution" requires showing a reasonable possibility of persecution — lower than the "clear probability" standard for withholding of removal. The standard accommodates both subjective and objective components.
Why it matters. Cardoza-Fonseca established the lower asylum standard relative to withholding — "reasonable possibility" suffices.

Common Mistakes · what trips students

Rule. Asylum requires past persecution or well-founded fear of future persecution on account of one of five protected grounds, including political opinion.
Application (model). P was arrested and beaten by state police specifically for political activism. Because political opinion is a protected ground and severe physical mistreatment constitutes persecution where causally linked to the protected ground, the fact that P experienced severe physical harm directly attributable to her political activism by government actors means P has demonstrated past persecution on account of political opinion.
