Transmutation of property between separate and community characters requires an express written declaration of intent under California Family Code §852; commingling of separate and community funds does not automatically transmute character, as long as the separate property can be traced.

Holding. To effect a valid transmutation of property between spouses, an express written declaration must indicate that the character of the property is being changed; a mere designation of a spouse as IRA beneficiary did not constitute the required transmutation.
Why it matters. MacDonald established that transmutation requires more than just a transactional document — must include explicit transmutation language.

Rule. Transmutation requires an express written declaration of intent to change the character of the property.
Application (model). W signed a deed putting the property in joint names with H, but the deed did not expressly state that the character of the property was being changed. Because California Family Code §852 requires an express written declaration of intent to change the property's character, the fact that the joint-name deed did not contain express transmutation language means transmutation did not occur.
